MOBILE, Alabama -- A federal judge in Mobile last week reduced a steroids dealer’s prison sentence to probation.
Chief U.S. District Judge William Steelesentenced Ashley Dewayne Rivers in January to five months in prison for conspiracy to possess with intent to distribute anabolic steroids. But he agreed to a request by the U.S. Attorney’s Office to change the sentence to five years’ probation.
Assistant U.S. Attorney Gina Vann, in a court filing, indicated that Rivers had provided prosecutors with "substantial assistance" in their case against co-defendant Dr. Mark Peter Koch.
The Monroe County doctor, who pleaded guilty in the case, received a probation sentence last month. Vann’s filing offers no details about Rivers’ cooperation. It asks that Steele reduce the defendant’s sentence to five years’ probation.
The motion for a reduced sentence came just hours after Steele had denied a request by defense attorney James Robinson to change the sentence to probation. Steele wrote in his order that he lacked jurisdiction to change the punishment. That had to come from the U.S. Attorney’s Office.
In his letter to Steele, Robinson asked that his client be allowed to serve his sentence on probation so that he could work and help support his wife, their four children and his handicapped brother.
"Mr. Rivers will lose his job and the family will be unable to pay their house note and bills associated with day-to-day living," Robinson wrote.
Rivers, a satellite technician from the Morgan County town of Lacey’s Spring, admitted that he sold steroids to Koch. According to court documents, an informant paid Rivers about $2,000 that Koch had provided and picked up vials of Primobolan Depot and Testosterone Cypionate, both of which are injectable anabolic steroids that allow users to gain muscle mass quickly. He also bought Viagra.
